this is why manitory sentences and such are generally a bad idea. They
prevent the Judge from taking such things into account. Didn't the "Third
Strike" law make it possible for someone to go to jail for life for a
petty violation such as vagrancy or shoplifting or even throwing a
waterballon into a building.
