If it's any consolation, last time I had a talk with someone selling
Cobalt cubes, I asked about full source to the kernel, including their
custom drivers, so that customers could recompile kernels, for example
with non-executable stack patches.  The reseller called their technical
contact at Cobalt Micro, and they said no, customers can't recompile their
kernels.
*Soooooo*... maybe it's better for them to put Solaris in them and at
least admit that they are proprietary, rather than using Linux and
violating the GPL...
